Learned counsel for the petitioner states that after

completion of training by the petitioner, the petitioner was

admitted in Command Hospital (Southern Command) Pune on

27.6.2007. After medical examination, the petitioner was

discharged on 16.10.2007. The petitioner claimed disability

pension, which was denied vide order dated 7.2.2008 Annexure P-

2. The reason assigned is that the cause of disability i.e. ‘Non-

Organic Psychotic Disorder (F-28)’ was neither attributable to nor

aggravated by Military service. Learned counsel has further

pointed out that in Annexure P-2 itself it has been provided that in
C.W.P. No. 3740 of 2009 -2-

case the petitioner is not satisfied, he may prefer an appeal.

Learned counsel has drawn the attention of Court towards

Annexure P-3 i.e. an appeal filed by the petitioner. Learned

counsel states that the appeal has not been decided till date

although the same was filed on 15.7.2008.

Issue notice of motion.

Ms. Anjali Kukkar, Advocate, accepts notice on behalf

of respondents, on the asking of Court.

Considering the above, the respondents are directed to

deal with the appeal and take decision thereon within 4 months

from the receipt of certified copy of the order.

Disposed of in the above terms.
