Date Of Order :: 06/09/2010 Hon'ble Mr. Justice Ajay Rastogi Mr. Deepak Kumar Sharma, petitioner in person. Petitioner appeared in person and submits that after tender notice was published from the office of Deputy Commissioner (Administration), Commercial Taxes, Bharatpur, in terms of selections made, the petitioner was appointed to work as Man with Machine (Computer Operator) vide order dt.12.11.09 (Annx.4) and since then he was continuously discharging his duties but the same process has been again initiated by the respondent by notice inviting tender on 11.8.2010 (Annx.6) read with 20.8.2010 (Annx.7) and some placement agency has been approved by the respondent through which appointments are to be made. Petitioner further submits that when he too has been appointed while going through the same method, there is no justification to appoint fresh applicants through the process which has once been adopted by the respondent pursuant to which the petitioner was given appointment and replacement of the petitioner in the present circumstances is in violation of Article 14 of the Constitution.
Issue notice to the respondents along with a copy of this order as to why the petition may not be disposed off at the stage of admission, returnable by four weeks. Notices may be given ‘dasti’, if desired.
In the meanwhile, respondents are directed to allow the petitioner to continue on the post which he held pursuant to order dt.12.11.09 (Annx.4) and they are further restrained from replacing the petitioner with the appointments if made in reference to NIT dt.11.8.2010 (Annx.6) read with 20.8.2010 (Annx.7) till further orders.
