Heard
learned advocate Mr. SP Majmudar on behalf of petitioner, learned
AGP Ms. Jirga Jhaveri appearing for respondent State authority.
In
this petition, prayer made by petitioner to direct respondent to
first give opportunity of transfer/inter district transfer to
petitioner before making recruitments of Vidhya Sahayaks and make
appointments of new Vidhya Sahayaks after petitioner is transferred
as aforesaid order. For that, petitioner has already made
application giving choice of place to respondent but according to
learned advocate Mr. Majmudar that application so far not decided by
respondent.
If
that be so, it is directed to respondent to consider resolution
dated 1/4/2008 page 92 Annexure I and if application is still
pending before respondent. Let it be examined and decided in
accordance with aforesaid Government Resolution within a period of
fifteen days from date of receiving copy of present order and
communicate decision to petitioner immediately.
In
view of above observation and directions, present petition is
disposed of by this Court without expressing any opinion on merits.
However, in case if ultimate decision is adverse to petitioner, it
is open for petitioner to challenge same before appropriate forum in
accordance with law. Direct service is permitted.
