ORDER

Rule.

Mr.I.M.Pandya, learned Additional Public Prosecutor waives service of
Rule on behalf of respondents. The main matter i.e. Special Civil
Application No. 22276 of 2005 was disposed of by an order dated
12.12.2005. By the said order, after hearing the learned Advocate for
the petitioner and learned Assistant Government Pleader on advance
copy, the respondents were directed to treat the petition as
representation of the petitioner and dispose of the same
expeditiously and preferably within a period of three months from the
date of receipt of a copy of the order.

2. Grievance
is made by the applicant that despite above service of order on
respondent No.2 on 15.12.2005, no decision has been taken. The
applicant has also sent reminders.

3. Considering
the submissions made by the learned Advocate, this application is
disposed of by recalling the order dated 12.12.2005 passed in Special
Civil Application No. 22276 of 2005. Special Civil Application stands
revived. To be placed for further hearing before the appropriate
Court. This Civil Application is disposed of accordingly. Rule is
made absolute.
