Background
1. The Applicant filed an RTI application dt.30.3.09 with the PIO, General Post
Office, Delhi stating that he had written a letter dated 20.3.09 which was sent
by post vide No.497/Y.V.D and that he would like to know the action taken
on that letter. He also requested for reasons if no action has been taken.
Besides these points the Applicant also sought information against 20 other
points related to material scrap and Fitters. On not receiving any reply from
the CPIO he filed a complaint before the CIC on 23.1.09 stating that the
CPIO, GPO had refused to accept the RTI application . The Commission
issued a letter dated 17.6.09 to the CPIO , Dept. of Posts directing the him to
explain the reason for his refusal to take the RTI application at a hearing
scheduled for 29.7.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for July 29, 2009.
3. Mr. V.S. Kawadia, Dy .CPM, Delhi GPO cum CPIO represented the Public
Authority.
4. The Applicant was not present during the hearing.
Decision
5. The CPIO submitted in his letter dated 13.7.09 that an RTI application is
acknowledged by the GPO only after ensuring that it is in the list of the
CAPIO module or not. In this case, the RTI application dated 30.3.09
received relates to GNCT, Delhi which is not included in the list of the
Department’s CAPIO Module. Also, under the provisions of Para 6 of
instructions contained in the letter No.103-1/2007/RTI dated 12.10.2007 of
Dy. Director General (PG&QA) M/o Communications & IT Department of Post
received through the Chief PMG Delhi Circle’s endorsement No.PG/RIA-
14/2006-Ruling dated 19.10.2007, the RTI applications/appeals in respect of
only those Central Public Authorities whose name/address appears in a given
predetermined list should be accepted at RTI courier. Applications/Appeals
relating to other offices/Public Authorities are not to be accepted at the
counter and the Applicant be intimated in polite terms to forward the
application through other modes i.e. Dak Registered letter, speed post etc.
He further stated that on checking the CAPIO Module of the Department, it
has been found that Delhi Transport Corporation and GNCT of Delhi has not
been shown in the list.
6. In the light of the above explanation, the Commission rejects the complaint.
