Background:
Dr. (Ms.) Anubha Gupta of New Delhi filed an RTI-application with the
Public Information Officer, Netaji Subhash Institute of Technology, New Delhi,
on 5 November 2007, seeking a certified copy of the second stage advice from
CVC in connection with an inquiry related to the purchase of computers.
2. The PIO vide his letter dated 3 December 2007 replied to his RTI-
application. Not satisfied with the reply of the PIO, the Appellant filed an
appeal with the first Appellate Authority on 6 December 2007 who vide his
letter dated 19 December 2007 replied to the first Appeal. Thereafter, the
Appellant approached the Central Information Commission with a Second Appeal
on 07 January 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 4 July 2008.
4. Dr. Vijander Singh, Asst. Professor & PIO and Ms. Jalaja Santhanam,
represented the Respondents.
5. The Appellant, Dr. (Ms) Anubha Gupta, was present in person.
Decision:
6. The Commission heard both the parties and noted that according to the
Respondents, they had replied to the RTI-application of 5 November 2007 as also
to first appeal of 6 December 2007. According to the Appellant, however, the
authorities had not addressed themselves to the specific questions asked by her
in her RTI-application. After going through the documents presented before the
Commission, the Commission accepts the submission of the Appellant and
directs the Respondents to give a specific reply by 25 July 2008. In case the
Appellant finds even this reply non-specific and vague, she is free to approach
the Commission again.
7. The Commission ordered accordingly.
