Background:
Ms. Rakhi Sharma of Haridwar filed an RTI-application with the Public
Information Officer, Central Board of Secondary Education, Delhi, on 1 May
2007, seeking information relating to the Schools affiliated to the CBSE.
2. Not satisfied with the reply of the PIO, the Appellant filed an appeal with
the first Appellate Authority on 7 September 2007 and then approached the
Central Information Commission with a Second Appeal on 27 November 2007.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 7 July 2008.
4. Smt. Rama Sharma, PIO, Shri Joseph Emmanuel, Dy. Secretary and Shri
U.C. Bodh, Assistant Secretary, represented the Respondents.
5. The Appellant, Ms. Rakhi Sharma, was neither present nor send any
representative for the hearing.
Decision:
6. In the absence of the Appellant, the Commission heard the Respondents
who maintained that they had supplied all the information to the Appellant.
Actually, the RTI-application had four items of enquiry and according to the
Respondents the information regarding all of them were available on the
website, to which they referred the Applicant. However, the Applicant raised
certain points which were in the nature of interpretation of these Rules.
According to the Respondents, while broad guidelines were indicated to the
Appellant, she would have to ask the particular school for detailed
information/guidelines since the CBSE was responsible only for conducting the
examinations and to prescribe the curriculum for Secondary and Senior
Secondary Examinations based on national curriculum framed by the NCERT.
7. The Commission accepts the submission of the Respondents and disposes
of the case.
