                                  ORDER

The petitioner is a Police Constable against whom an

F.I.R. has been registered and the allegation raised is that he

has assets disproportionate to his known sources of income.

As soon as the F.I.R. is registered, the petitioner has come to

this Court. He prays that the F.I.R. may be quashed by

invoking the jurisdiction under Sec.482 of the Cr.P.C.

2. What is the reason? The learned counsel for the

petitioner submits that the petitioner’s wife runs a business

and the family has ample source to justify the assets. This is

the question which the petitioner must raise before the

Investigating Officer. He will certainly be at liberty to show

to the Investigating Officer that he has no assets

disproportionate to his known sources of income. I have no

reason to assume that the Investigator will not consider this

aspect to the matter. At any rate, I find absolutely no merit in

the prayer to quash the proceedings on the ground that the

petitioner shall be able to explain his assets with the theory that

his wife has a business and income therefrom. The prayer is

without any merit.

3. This Crl.M.C. is, in these circumstances, dismissed.
