05. 01.07.2011 Heard learned counsels for the petitioner and the

State.

The prayer of the petitioner is that respondents

deserve to be directed to conduct impartial investigation in

connection with Islampur P.S. Case No. 59 of 2010 registered

on 10th of April 2010 for the alleged offence under Sections

302, 201, 120(B)/34 of the Indian Penal Code.

A counter affidavit has been filed on behalf of the

State stating therein that upon investigation police has

submitted a charge sheet with respect to two accused

persons, namely, Mahadeo Prasad @ Mukesh Kumar and Karu

@ Sandip and for rest of the accused persons, investigation is

going on.

Learned counsel for the petitioner submits that for

rest of the two accused persons whose involvement are very

much apparent, investigation is not being properly done.

Considering the submissions of the parties, the

investigation with respect to rest of the two accused persons

in connection with the aforesaid case be completed without

unnecessary delay and upon completion of the investigation

police report be submitted forthwith. However, with regard to

any grievance with respect to investigation which is said to be

pending against rest of the two accused persons, it will be

open for him to bring it to the notice of the concerned

Superintendent of Police with cogent information/materials

who will look into the matter and take remedial measure as

per law.

Accordingly, the writ application accordingly stands

disposed of.
