Ms.Hingorani,
counsel for the appellant submitted that she has been instructed that
the respondents have requested to withdraw the Appeal. She produces a
letter dated 7th April 2011 written by Additional Chief
Engineer (T & C), Mehsana addressed to the Superintending
Engineer, UGVCL, Circle Office, Mehsana, whereby approval has been
granted to withdraw the Letters Patent Appeal No.1090/2010 arises out
of Special Civil Application No.4262/1997.
In
view of the aforesaid instruction and the request made on behalf of
the appellant, the appellant is permitted to withdraw the Appeal with
a liberty to the appellant to take action against the defaulter
employee, if any.
The
Appeal stands disposed of.
