ORDER

This
matter was listed yesterday and was ordered to be kept today on the
request made by learned for the respondent – corporation that
learned Senior Counsel appears in this matter.

Today,
when the matter is called out, similar request is made to adjourn the
case and such request is rejected.

Having
heard learned counsel for the parties and perusing the record of the
case, it appears that in Special Civil Application No.9562 of 2001
learned advocate appearing for the respondent – corporation
stated on instructions that, upon scrutiny of the case of the
petitioner, it was found to be genuine and it was resulted that the
petitioner should be and shall be granted benefits to which he is
entitled, including regularization in service with retrospective
effect and all consequential benefits in accordance with rules of the
respondent, later on. However, the corporation has taken a different
stand and the petitioner, who has put about 24 years of service, is
without any promotion though the vacancies on the post are available.

In
view of the above, Rule returnable on 19th
October, 2011.

In
the meanwhile, the respondent authorities are directed not to
terminate the services of the petitioner.
