                      J U D G M E N T

This writ petition is filed with a prayer to direct the

Crime No.761/08 of Guruvayur Police Station be investigated

by such other efficient and impartial investigating agency for

proper investigation. The learned Magistrate considered the

prayer and held that the police is investigating the matter.

The petitioner filed petition to direct the S.H.O. Guruvayur to

send the document in question to Forensic Science

Laboratory for examination of photograph therein. The

learned Magistrate also observed that he has called for a

report of the Investigating Officer and the investigating

officer’s report appears to be that there is some trick played

by the present petitioner. Whatever it may be, the matter is

under investigation and the Magistrate has applied his mind

and found that a particular mode of investigation cannot be

ordered to be conducted. If there is anything wrong with the

investigation and if it is glaring it can be brought to the

notice of the Court and it can also be considered by the

Court. But the party cannot dictate the mode of

investigation to be done by the investigating agency. So at

this stage there is nothing to interfere and therefore this writ

petition is dismissed.
