Heard learned counsel for the applicant, learned A.G.A. and
perused the entire record of the case.
The submission of learned counsel for the applicant is that co-
accused Dilip Chaudhary and Jai Prakash have already been
granted bail by this Hon’ble Court vide Criminal Misc.Case
No.8904(B) of 2009, dated 22.12.2009 and the case of the
present applicant is similar to that of co-accused . Learned
counsel for the applicant claims parity, which is not disputed by
the State counsel. It is further submitted that the offences so
levelled against the accused applicant are triable by Magistrate.
The applicant is in jail since 26.10.2009 and there is no criminal
history of the accused applicant, as averred in paras 18 & 19 of
the bail application, which is admitted by the State.
Considering the overall aspects of the matter, I hereby provide
that the applicant be released on bail in Case Crime
No.1248/2009, under Sections 406, 419, 420, 411 IPC, P.S.
Dargah Shareef, District Bahraich, on his filing a personal bond
and two sureties each in the like amount to the satisfaction of the
court concerned.
