       Shri S.P.Tiwari, counsel appearing for respondent no.2

submitted that earlier the representation of petitioner was
decided vide Annexure C-3, thereafter when the respondent
no.2 commenced the proceedings for removal of
encroachment, the encroachers obtained interim writ from this
Court and because of this it is not possible for respondent no.2
to remove the encroachment. He has shown us copy of the
order passed in W.P.No.12619/2011 in which ad-interim writ
was issued on 29.7.2011.

In view of aforesaid, substantially the order dated
7.5.2010 passed in W.P.No.4710/2010 (P.I.L.) has been
complied with. However, respondent no.2 may initiate further
proceedings after decision in writ petition no.12619/2011.

With the aforesaid, the proceedings are closed, with no
order as to costs.
