                        J U D G M E N T

The petitioner’s husband is the owner and in possession of

14 cents of property in survey No.735/10 of Cheranelloore

village. The 2nd respondent is the adjoining property owner who

owns 6 cents of property on the eastern side of the petitioner’s

husband’s property.

2. The petitioner complains that certain constructions have

been made by the 2nd respondent in violation of the Kerala

Municipality Building Rules. This has persuaded her in filing of a

complaint before the Panchayath which is evidenced by

Exhibit P1. Exhibit P2 shows that the same has been received by

the Panchayath. The alleged delay in examining the complaint

and taking action required has resulted in filing this writ petition

by the petitioner seeking for various reliefs.

Heard the learned counsel for the Panchayath. It is

submitted that they have received the complaint and they will

verify the details and depute a competent officer for local

inspection and thereafter appropriate action, if any, required will

be taken in accordance with law. The said submission is recorded

and the Panchayath will enquire into the matter. If any action is

proposed, the same will be taken only after notice to the

petitioner and the 2nd respondent also and by giving an

opportunity of hearing. The result thereof will be communicated

to both parties.

This writ petition is disposed of as above. No costs.
