2. 15.9.2011 Heard learned Counsel for the petitioner and the

State.

The petitioner seeks bail in Barachatti P.S. case

No.40 of 1998 (S. Tr. No.31 of 2011/ 23 of 2011) instituted for

the offence u/ss.147, 148, 149, 341, 342, 307, 323, 324, 376,

354, 511, 448 and 380 of the Indian Penal Code.

Considering that the case is of the year 1998 and the

petitioner surrendered only recently, I am not inclined to grant

bail to the petitioner.

The prayer for bail is rejected.

If there is inordinate delay in conclusion of the trial

for reasons not attributable to the petitioner, he may renew his

prayer for bail.

It has been submitted that the petitioner is 89 years

old man, which fact will be verified by the court below and if it

is found that indeed the petitioner is an old man and unable to

move freely, the court below shall release the petitioner on

bail on surety fixed by it.
