         Shri   P.K.     Kaurav,   learned   Dy.   A.G.    for   the
respondents.

Petitioner has sought following reliefs :-

1. To call for the relevant record on the report
of petitioner from the respondents.

2. To direct the respondents to register the
offence against Niresh Mishra and other co-
accused accompanied with him while
committing the offence and they he arrested
for prosecution in the competent court of
law.

The case of the petitioner is that on the basis of the
complaint Annecure P-1 no action has been taken by
respondent No.3 so this petition has been filed. From the
perusal of the report Annexure P-1, it appears that a
cognizable offence was committed, hence the matter
deserves to be enquired into by respondent No.2.

In view of the aforesaid this petition is disposed of
finally with the following directions :-

1. Petitioner to approach respondent No.2 by filing a
fresh complaint alleging his grievances supported by
a copy of this petition with annexures for the ready
reference of respondent No.2.

2. The respondent No.2 on receipt of the aforesaid
complaint shall pass an appropriate order and if a
cognizable offence is made out, issue appropriate
directions in this regard.

3. All these exercise shall be done by respondent No.2
within 90 days from the receipt of such complaint.

4. If the matter has already been enquired into, by the

respondent No.2 or 3, no further action shall be
required but the petitioner shall be intimated in that
record by respondent No.2 and 3, as the case may
be, by registered A.D. mode.

No order as to costs.
