02. 15.11.2010 In terms of the earlier direction of the High Court passed in

CWJC No. 1121 of 2003, the speaking order dated 29.11.2003 has been

brought on record by the State as part of their counter affidavit.

There is no question for giving any direction for payment of

salary or wages to the petitioner for the so-called period he had worked

in view of the disputed position which has emerged with regard to the

petitioner having actually worked on the post for the period. The facts

being what they are the Court cannot give any direction on the position

which emerges in this case.

The writ application is dismissed.
