                                          ORDER

Shri Ghanshyam Singh Yadav, the appellant has filed this appeal dated 9.12.2010
before the Commission against Delhi Police, East District, for not providing information to
his RTI-request dated 17.7.2010, which came up for hearing on 18.04.2011. The appellant
was present in person, whereas the respondents were represented by Shri Sumer Singh,
ACP.

2. The appellant filed RTI-request dated 17.7.2010 seeking information on seven RTI-
queries pertaining to his complaint dated 22.7.2002 for filing a patricidal FIR against Lalji
Singh Yadav for murdering his father. The PIO vide letter No. 8762-Info. Cell/East Distt
dated 18.8.2010 has replied to the appellant stating that as per report received from SHO,
New Ashok Nagar, the information sought by the appellant cannot be provided as the
records of complaints upto 2004 has been destroyed.

3. Aggrieved by the decision of PIO, the appellant preferred first-appeal on 5.10.2010
before FAA. The FAA vide order No. 204/10/17946/A-RTI/East Dist dated 10.11.2010 has
upheld the decision of PIO.

4. During the hearing the respondents submitted that appellant’s father died on
15.6.2002, while the appellant filed his complaint on 22.7.2002 after a month. The
information sought by the appellant to pertained old records, which have been destroyed.

5. After hearing the parties and on perusal of the relevant documents on file, the PIO
is directed to provide proof and order of destroying of the said record, within two weeks
of the receipt of this order.

The matter is disposed of with the above directions.
