Facts
arising from the Complaint:
Mr. Nitesh Kumar Tripathi filed a RTI application with the PIO, Dept. of Social
Welfare, GNCTD on 25/09/2009 asking for certain information. However on not having
received the information within the mandated time, the Complainant filed a complaint
under Section 18 of the RTI Act with the Commission. On this basis, the Commission
issued a notice to the PIO, Department of Social Welfare on 14/12/2009 with a direction
to provide the information to the Complainant and further sought an explanation for not
furnishing the information within the mandated time.
The Commission has received a letter dated 06/01/2010 from the PIO/Assistant
Director (Disability), Dept. of Social Welfare wherein it has been stated that the said RTI
Application was not received in their office. Further, however, in compliance to the
Commission’s direction vide its notice dated 14/12/2009, the PIO has provided
information to the Complainant vide a letter dated 05/01/2010, copy of which was
enclosed.
Decision:
The Complaint is disposed off.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act,
2005.
