Facts
arising from the Complaint:
Mr. P. Narasimham had filed a RTI application with the PIO,UGC, Delhi on
29/06/2009 asking for certain information. The application was subsequently transferred
by the PIO,UGC to PIO, IGNOU (DEC) for providing the requisite information.
However on not having received the information within the mandated time, the
Complainant filed a complaint under Section 18 of the RTI Act with the Commission on
07/10/2009.On this basis, the Commission issued a notice to the PIO, IGNOU (DEC) on
20/10/2009 with a direction to provide the information to the Complainant and further
sought an explanation for not furnishing the information within the mandated time.
Subsequently, the Commission received a letter dated 30/10/2009 from the PIO,
IGNOU, DEC stating that information has been provided to the Complainant vide letter
dated 22/07/2009.
Decision:
The Complaint is disposed off.
The Commission warns the PIO to ensure that information is given to applicant(s)
within 30 days as mandated under Section 7 (1) of the RTI Act, 2005 and further warns to
ensure that the particulars of the Appellate Authority is also provided to the applicant(s)
as mandated under Section 7 (3) (b) of the RTI Act, 2005.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
