Facts

:­ 
 

 1. The Appellant Sri P. Vasudeva Rao, vide RTI application dt. 27.8.2009 sought 
information from CPIO, LIC, Khammam district in respect of date of birth of Sri Kota 
Yoga Nanda and Sri Kota Janardhan Rao.   He   sought information to establish that 
they were Freedom fighters since some villagers  had raised objection regarding their 
genuine  date  of  birth.    The  CPIO  (order  not  enclosed)    denied  disclosures  under 
section 8(i)d and 8(i)j of the Act. 

2. Being aggrieved and not satisfied the Appellant preferred the first appeal   dt. 
6.9.2009 before FAA, which was adjudicated vide FAAO dt.14.9.09 in which he upheld 
the decision of the CPIO.  

3. The Appellant has come before the Commission. The matter was heard today 
through Video Conferencing. Both the parties were present as above. 

Decision

4. After hearing the arguments of both the sides, the Commission   directs the 
respondent  to take action under Section 11  of the Act to obtain the consent of both 
the  third parties for allowing disclosure. If consent is received, then after applying the 
severance provision under Section 10 of the RTI Act,   the respondent can provide 
photo copy of only that portion of the LIC policy which shows the name and date of 
birth in  respect of both the persons.  Respondents to take action within one week of 
the receipt of  this order
