                                                ORDER

                 The Commission has received a petition from Shri Pankaj of Kanpur 

stating   that   his   RTI­application  of   6   May  2011  filed   with   the   Central   Public 

Information Officer, Department of Personnel & Training, New Delhi, has not 

been   responded   to   within   the   time   limit   prescribed   under   the  Right   to 

Information (RTI) Act, 2005.  A copy of his RTI­application is enclosed for ready 

reference.

2.       The Commission has decided to treat this petition as a complaint under 

Section   18   of   the   RTI­Act,   2005,   and   hereby   directs   the   CPIO/Public 

Information Officer, Department of Personnel & Training, New Delhi, to provide 
the information sought by the Complainant by 1 December 2011. 

3.         Since the PIO has failed to respond to the RTI­application mentioned 

above in time, he is, therefore, required to send his explanation in writing by 9 

December 2011 to Show Cause as to why a maximum penalty of Rs.25000/­ for 

the delay in supply of information may not be levied upon him.     If no written 

explanation is received from the CPIO by 9 December 2011, the Commission 

will   decide   the   case   ex­parte   and   would   impose   the   maximum   penalty 

prescribed under Section 20(1) of the  Right to Information (RTI) Act, i.e., Rs. 

25,000/­, upon the CPIO/deemed PIO. If, however, the CPIO had responded in 

time and provided the desired information, please let us know at the earliest.

4.         The   Complainant   is   advised   that   in   case   he   does   not   receive   any 

information from the CPIO after this order of the Commission, he may write to 

the Commission against the non­compliance of the Commission’s orders.

5.     The Commission ordered accordingly.
