                                                           ORDER

1. The Commission on perusal of the submissions on record noted that the information sought is similar 

to  the  one  already  decided  by  this Bench in case No.CIC/AD/A/2011/001907 dt.24.10.11.     The 

decision pronounced in that case is reproduced below which holds good in the instant case too.

During the hearing  held on 24  October 2011  the Appellant insisted that  he be provided  under RTI  
the ownership papers (Jamabandi) after erasing the comments of the Patwari made on the papers,  
with a pencil.   The Respondent submitted that   this would mean creation of new information and  
hence he is not in a position to erase  the  Patwari’s comments written on the ownership papers. He  
however expressed his willingness  to provide another copy of the Ownership papers after  attesting  
the same (Without the Patwari’s comments)  under a covering letter clearly stating that the comments  
written by the Patwari cannot be erased in the original documents  and that the attested copy of the  
ownership   papers     that   have     been   provided     may   be   treated     as   original   hence   forth.     The  
Commission accordingly recommends that the Public Authority  consider providing  the attested copy  
of the ownership papers   without the comments of Patwari to the Appellant,   preferably within one  
month of receipt of this order.

2. The appeal is disposed off accordingly.
