ORDER
Background
1. The Applicant filed 5 RTI Applications (all dated 25.7.11) with the PIO, DRM Office, East Coast
Railway, Waltair. She stated that the five individuals viz. Shri Kuppili Satyanarayana Reddy, Shri
Muppana China Malleswara Rao, Shri Bobbili Krishna Murthy, Shri Patheti Venkata Ramana and Shri
Mylapilli Jagga Rao expired while in service and that while in service they had borrowed money from
her and failed to repay the same. As the people who had borrowed the money had expired, she
wanted to add their legal heirs as parties in the legal proceedings and that she has come to know that
the legal heir each of the expired employees was given appointment on compassionate grounds. In
this context, she sought the following information :
a) Amount kept in abeyance for payment in connection with the Execution Petition
b) Copy of the legal heir certificate produced by the family members of late employees to your
organization.
c) Name of the legal heir who was given appointment in your organization on compassionate
grounds, along with his
i) Designation
ii) PF No.
iii) Working under which Divisional Head of the Department
iv) Present working address of the individual
v) Present residential address of the individual
Shri B.Somulu, PIO replied on 29.7.11 denying the information u/s 8(1)(j) of the RTI Act since the
disclosure has no relation with any public activity or interest and is being sought to file a suit for
realization of debt amount which is in personal interest.
Decision
2. The Commission on perusal of submissions on record directs the PIO to provide the information
against points C(i), C(iii) and C(iv) and b if available on record to the Appellant as the information is
already in circulation. The information against points A is not available with the Public Authority and
hence cannot be disclosed. The information sought against points C(ii) and C(v) are denied u/s 8(1)(j)
of the RTI Act since the information sought is personal in nature the disclosure of which has no
relation with any larger public activity or interest. The information should reach the Complainant by
7.11.11 .
3. The complaint is disposed of with the above directions..
