Background
1. The Applicant filed an RTI application dt.18.3.08 with the CPIO, DoP,
Ajamgarh. She stated that she had sent a parcel from Bhiwadi to Azamgarh
on 20.6.06. The parcel was opened while it was in transit and the items were
removed and a smaller parcel was handed over to her at Azamgarh. A
complaint was then lodged with the Postmaster, Bhiwadi which was
transferred to the Azamgarh Postmaster. After investigation at Azamgarh, the
parcel that was handed over to Applicant was taken back as not belonging to
the Applicant without replacing it with the actual parcel. The Applicant was
not provided with the investigation report nor was there any communication
from the post office to her. The Applicant then sent seven to eight
representations to post offices in Bhiwadi, Jaipur and Azamgarh. However the
she received no response. Meanwhile, the Superintendent of Post Office
Azamgarh also wrote to the Applicant on 12.7.06 stating that the parcel may
have been tampered with during the 11 days transit from Bhiwadi to
Azamgarh. He also admitted in that letter that an investigation was
conducted and the report was sent to Postmaster, Bhiwadi. The CPIO replied
on 7.4.08 stating that information cannot be provided as the matter is sub-
judice. Aggrieved with not receiving any information regarding the
investigation, the Applicant filed a complaint with U.P. State Information
Commission on 1.5.08 who transferred the case to CIC on 24.11.08.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 8, 2009.
3. The Public Authority was absent at the hearing.
4. The Applicant’s husband was present during the hearing.
Decision
5. The Commission, after hearing the Appellant’s submission, directs the CPIO,
Azamgarh and Bhiwadi to provide the required investigation report to the
Appellant by 5th June, 2009 under intimation to the Commission.
6. The CPIO, Bhiwadi to showcause why a penalty of Rs. 250/- per day should
not be imposed upon him for not providing the investigation report to the
Appellant within the mandatory period. The response to reach the
Commission by 5 June 2009.
