This is a petition for regular bail.

2. The petitioner is the accused in O.R. No.55/2008 of

Pathanamthitta Excise Range alleging commission of offence

punishable under sections 55(a) and 67(B) of the Kerala Abkari

Act. The case is that the petitioner was allegedly found

transporting 10 litres of illicit spirit on 19/8/2008. He was arrested

in another case in which warrant was pending on 7.4.2009 and

arrest in this case was recorded by the excise officials and he is in

judicial custody.

3. I have heard the counsel for the petitioner and the

learned Public Prosecutor. Having considered the facts, I think

the petitioner can be enlarged on bail with conditions.

4. Accordingly, this application is allowed.

i) The petitioner shall be enlarged on bail on

his executing a bond for Rs.50,000/- (Rupees fifty thousand only)

with two solvent sureties each for the like sum to the satisfaction

of the Judicial First Class Magistrate-I, Pathanamthitta.

ii) The petitioner shall report before the investigating

officer on all Saturdays between 10 a.m. and 11 am.
