While arguing the case on merit, it was stated by Shri
R.N.Singh, learned Senior Advocate that the refreshment room,
which is being run by the petitioner is providing food facility to
the public at large at a very concessional price, which is fixed by
the Railway. Though there is another food stall in the name of
Meenakshi, one Food Plaza run by Samdariya Group and one
Non-Vegetarian stall in the name of M/s Ibrahim, but in the
refreshment room the public at large is getting food at a rate
which is very moderate, while in the Food Plaza though the food
is available, but at a very higher rate, for e.g., he has quoted
the price of food @ Rs.22/- per thali in the refreshment room,
while in the Food Plaza @ Rs.74/- per thali. It is stated that by
closure of refreshment room public at large will suffer.

On raising such contention, we find that though in para
6.2 of the petition vague allegations have been made, but there
is no specific allegation regarding the aforesaid facts, so we
permit petitioner to amend the pleadings so that the aforesaid
facts may come on record.

Shri Ruprah, submitted that on 9.2.2011 he has moved an
application for vacating ad-interim writ, a copy of the same is
supplied to the petitioners.

Reply, if any, may be filed by 14.2.2011.

Be listed for hearing on 22.2.2011.

In the meantime, petitioners if advised so, may amend
W.P.No.839/2011

the pleadings by filing an appropriate application on 14.2.2011,
after supplying a copy of it to the other side.

Ad-interim writ issued earlier to continue till 22.2.2011.
