1. It was brought to our notice that the issue relates to Modvat. Issue with reference to maintainability of appeals in respect of Modvat credit has already been considered by us as per our earlier Order No. 249-299/2001, dt 27.2.2001, following the ratio of that decision, this appeal is dismissed as not maintainable.
