Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that the applicant was not named
in the FIR and any article mentioned in the FIR alleged to have been looted
were not recovered from the possession of the applicant. When the recovery
was shown. The recovery was shown of a silver and role gold item.
Subsequently the case was improved and silver ring of the victim was shown
to have been recovered from the possession of of the applicant. There is no
criminal history against the applicant. However, the applicant is in jail since
18.4.2009.
In view of the aforesaid fact without expressing any opinion on merit, let the
applicant Munney Khan be released on bail, in case crime No. 308 of 2009 u/s
394 and 411 IPC. P.S. Bhojipura District Bareilly on his furnishing a personal
bond and two sureties each in the like amount to the satisfaction of the court
concerned.
