Petitioner was working in the respondent Corporation. In
accordance to the scheme formulated by the Corporation, petitioner
was granted voluntary retirement and vide order-dated 12.4.2006, VRS
of the petitioner was accepted, all the monetary benefits were paid to
the petitioner and has settled all his claims.
Now after a period of four years, petitioner has filed this writ
petition and contends that he had withdrawn the application submitted
for grant of VRS and inspite of withdrawal of the application, he has
been granted retirement which is unsustainable.
Petitioner was granted VRS in the year 2006 and now after a
period of more than four years when the matter has been settled and all
the benefits granted, interference by this Court is not proper. When the
VRS of the petitioner was accepted and he was retired in the year
2006, in case petitioner had any grievance in the matter he should have
immediately challenged the action by approaching this Court, instead
he accepted all the monetary benefits and remained quiet for four
years. Now, after a period of more than four years, it is not proper to
interfere in the matter and reopen the settled claim, which stood
concluded by acceptance of the VRS by the respondents in the year
2006 and payment of all monetary dues to the petitioner.
Accordingly, finding no case for interference now after a period
of more than four years, in the matter of withdrawal of voluntary
retirement sought by the petitioner, this petition is dismissed.
