Through
this application, applicant original petitioner seeks restoration of
Special Civil Application No.5953/1998 which came to be dismissed for
default on 15.2.2007. Though this application is filed in time,
learned advocate for the opponent is right in pointing out that twice
before the petition had been dismissed for default.

Under
such circumstances, though restoration is granted, same is on
condition that the applicant shall deposit a sum of Rs. 2000/- with
the Gujarat High Court Legal Services Committee.
