The petitioner has filed the above writ petition seeking to issue a writ of mandamus directing respondents 1 and 2 to take appropriate action against the third respondent for the construction put up in Survey No.30/4, in Alandur Village at Old No.32A and New No.42 Vembuli Subedar Street, Alandur Chennai 16.
2. Pursuant to the direction of this Court, the second respondent Commissioner, Alandur Municipality has filed a counter affidavit highlighting their stand. Among the information furnished, the details mentioned in paragraph No.5 are relevant, which reads as follows:
“5. Thereafter on 29.12.2006 the third respondent submitted an application for Building permission. The application was considered and it was found that the same was not in conformity with the Development Rules as follows:-
i. Area of site is less than 90 Square Metres. (Only 63 available) ii. Passage is less than 10 feet (Only 5 Feet available) iii. Side Set back of 5 feet on both sides not given. Set back given only on one side.
Apart from this the Front and rear set back have not been provided and Pillars have been raised at the front and back at the edge of the property. The order of rejection was passed on 3.1.2007 and was sent to the third respondent in person and received on the same day.”
It further shows that apart from the dispute relating to the construction which is a subject matter of the present writ petition, the petitioner and the third respondent have some other dispute and according to the petitioner, the third respondent has already approached the Civil Court.
3. Learned counsel appearing for the third respondent submitted that the third respondent undertakes that he will not put up any further construction till the disposal of the civil proceedings. The above statement is hereby recorded.
4. It is made clear that in respect of the allegations relating to encroachment/trespass of the property as alleged by the petitioner, it is for the parties to vindicate their grievance in the Civil proceedings. The second respondent is free to take appropriate action if there is any violation, in respect of the construction put up in Survey No.30/4 Old No.32A and New No.42 Vembuli Subedar Street, Alandur Chennai 16. It is further made clear that against the order of rejection dated 03.01.2007, the petitioner is free to file an appeal before the appropriate authority and the appropriate authority is free to consider and dispose of the appeal in accordance with law.
With the above observation, this writ petition is disposed of. No costs. Consequently connected miscellaneous petition is closed.
