                                      ANTONY DOMINIC, J.

                            ---------------------------------------------------

                                     W.P.(C) 35296 OF 2007

                            ---------------------------------------------------

                                    Dated: December 3, 2007

                                             JUDGMENT

This writ petition has been filed for directing the 2nd respondent to issue tender

forms to the petitioner and to consider the tender without insisting on EPF registration.

2. The writ petition has been filed following the issuance of Ext.P2, by the 2nd

respondent, inviting tenders for execution of certain works. It is the admitted position

that the petitioner does not possess EPF Registration and the tender notice itself says

that tenders are invited from contractors who are having EPF registration. If that be so,

the petitioner is ineligible to be issued tender forms.

3. However, the 2nd respondent submits before me that if the petitioner

undertakes to obtain registration from the EPF Department, they are willing to issue

tender documents.

4. Therefore, I direct that if the petitioner furnishes an undertaking that he will

obtain registration from the EPF Department before submitting the tender, the petitioner

will be issued tender documents.

This writ petition is disposed of as above.
