ORDER
1. By
way of this petition under Article 226 of the Constitution of India,
the petitioner has prayed for an appropriate writ, order and/or
direction, directing the respondent Nos.2 & 3 to execute the
Recovery Certificate issued by Labour Court, Rajkot (Annexure B
to the petition).
2. In
response to the Notice issued by this Court, Mr.P.P.Majmudar, learned
advocate has appeared on behalf of respondent No.1 and has submitted
that with respect to very impugned order passed in Recovery
Application, came to be challenged before this Court by respondent
No.1 herein being Special Civil Application No.9227 of 2010 and this
Court disposed of the said petition by granting 12 equal monthly
installments to the respondent herein to make payment under the
Recovery Certificate. Therefore, it is submitted that no further
order is required to be passed by this Court in light of the order
dated 11/08/2010 passed by this Court in Special Civil Application
No.9227 of 2010.
3. Mr.Kishor
Paul, learned advocate appearing on behalf of the petitioner confirms
the same. However, he has submitted that in view of communication
gap, he was not aware of the same. Be that as it may. Considering the
order dated 11/08/2010 passed by this Court in Special Civil
Application No.9227 of 2010, no further order is required to be
passed in the present proceedings. Respective parties to abide by the
order dated 11/08/2010 passed by this Court in Special Civil
Application No.9227 of 2010.
With
this, the present petition is disposed of. Notice is discharged.
Ad-interim relief, if any, stands vacated forthwith. No costs.
