04/   20.09.2010             On 16.09.2010 when this case was called out for

consideration, no one appeared on behalf of the petitioner and hence

the case was adjourned as a last chance.

Today also when the case is called out, no one appears on

behalf of the petitioner to press this matter.

Accordingly, this writ petition is dismissed for non-

prosecution.

It transpires that this case had been filed in the year 2006,

i.e. four years back and the matter has already been unnecessarily

delayed. Hence, the award dated 07.12.2005 (Annexure-1) passed

by Presiding Officer, Labour Court, Muzaffarpur in Reference Case

No.04 of 1998 be immediately implemented.
