The claim made in the present writ petition is for counting
the work charge service towards the pensionary benefits. Number of
writ petitions containing identical challenge came up for hearing
before this court on 27.4.2011 and have been disposed of by issuing
directions to the respondents to seek a fresh option, if need be, and
to count the work charge service for the purpose of grant of retiral
benefits in terms of law laid down by the Hon’ble Supreme Court in
Civil Appeal No.4903 of 2009 (Dakshin Haryana Bijli Vitran
Nigam Limited Versus Bachan Singh), decided on 30.7.2009.
In view of the order passed in Civil Writ Petition
No.19123 of 2010 (Mangal Singh and others Versus Uttar
Haryana Bijli Vitran Nigam Limited and others), decided on
27.4.2011, the present writ petition is disposed of in the same terms.
