Heard learned counsel for the accused applicant and the learned AGA.
It is contended on behalf of the accused applicant that the accused was
arrested on the spot alongwith 12 kg. of copper wire. It is further submitted by
him that three cases are pending against him . Out of which one is related to
this very incident but he has not been convicted in any of the cases. Learned
AGA also pointed out that there are five criminal cases pending against the
accused but as per his instruction in none of the cases any conviction is
reported to have been recorded by any criminal court. The accused is in jail
since 4th of October, 2009.
Without going into merits of the case at this stage I think it expedient that the
accused be released on bail.
Let accused applicant Rajendra @ Rajjan involved in Case Crime No.1072
of 2009 under Sections 136 of Electricity Act, and under Sections
379/411 IPC and under Section 3 of the Prevention of Public Property
Damages Act, 1984, Police Station Baruasagar, District Jhansi be released
on bail on his furnishing a personal bond and two sureties each in the like
amount to the satisfaction of Magistrate concerned plus following undertaking
that :
1. In future the applicant will not engage himself in any such illegal activities
of theft relating to electric wire .
2.The applicant will not tamper with the evidence during the trial.
3. The applicant will not pressurize/intimidate the prosecution witness.
4.The applicant shall not absent himself from appearing in the Court on the
date fixed without prior permission of the Court.
