Addl. Public Prosecutor for the State.
Petitioner being husband of the deceased is languishing in
jail custody since 4.4.2011 in a case registered under sections 302, 201
of the IPC and 27 of the Arms Act.
Admittedly, Piri Bazar P.S. Case no. 39/2010 was registered
against unknown person when the dead body of a woman was
recovered.
In course of investigation, it came to light that the aforesaid
dead body was of Sangita Devi and subsequently, it also came to light
that the petitioner is the husband of the aforesaid deceased.
In course of investigation, at para 29 of the case diary, one
witness, namely, Parmila Devi, stated that she was tenant of the
aforesaid Sangita Devi who used to collect rent from her. She has
specifically stated that the deceased used to come to collect rent alone.
Furthermore, mother of the deceased has stated that at time of alleged
occurrence, the deceased was residing in Munger district but she has
nowhere stated in her statement that the petitioner was also residing
with the deceased. Furthermore, it came to light that in course of
investigation the deceased was a woman of doubtful character and she
was engaged in committing the crimes.
It would appear from perusal of the case diary as well as

submissions of the parties that name of this petitioner has been
dragged in the murder of the deceased only because he is husband of
the deceased.
Considering the above stated facts and circumstances as
well as submissions of the parties, let the petitioner, Rajniti Pd. Verma
@ Pappu Verma, be released on bail on furnishing bail bonds of Rs
10,000/- with two sureties of the like amount each to the satisfaction
of the Addl. Chief Judicial Magistrate, Lakhisarai in Piri Bazar P.S.
Case no. 39/2010.
