counsel for the petitioenr and Shri Shashi

Shekhar, learned A.C. to S.C.9.

The petitioner, who retired with

effect from 31.1.2009 as Assistant from the

department of Health, has prayed for

directing the respondents for making

payment of all his retiral dues. It has

been stated that save and except payment of

the amount of Group Insurance, nothing has

been paid to the petitioner. It was

submitted by learned counsel for the

petitioner that petitioner has filed

representation before respondent

no.4/Principal Secretary, Health

Department, however, no decision has been

taken till date.

With the consent of parties, the

writ petition is being disposed of with

liberty to the petitioner to file a fresh

representation before respondent no.4

within a period of six weeks from today. If

such representation is filed, the

respondent no.4 is directed to examine the

same and pass appropriate order in

accordance with law redressing all the

grievances of the petitioner within a

period of three months from the date of

filing of such representation. It is

directed that in the meanwhile, all the

respondents including respondent no.4 shall

take all steps for clearing all the

admitted dues. In case of refusal, the

respondent no.4 is directed to pass a

speaking order within three months from the

date of filing of such representation. It

is made clear that petitioner shall be

entitled to get admitted interest on

delayed payment. After issuance of sanction

by respondent/State, the respondent

no.8/Accountant General is required to

issue authority letter within a period of

one month from the date of receipt of

sanction from the respondent/State.

With the aforesaid observation and

direction, the petition stands disposed of.
