02. 29.10.2010 Heard learned counsel for the two

petitioners and learned Additional Public

Prosecutor for the State.

As submitted by learned counsel for the

petitioners that petitioner no. 2 namely, Ratan

Kumar Choudhary, has been apprehended by the

police. Hence, prayer to his extent has become

infructuous.

So far as petitioner no. 1 is concerned,

he is named accused in this case carries

allegation of inflicting injuries by Farsa upon

forehead of the informant during the course of

attempt on overhead, but injury report speaks a

bit otherwise. There is counter version also

between the parties and there is also land

dispute.

Considering the facts and circumstances

of the case, in the event of his

arrest/surrender before the court below within

four weeks of receipt of the copy of this

order, petitioner, namely, Rama Kant Sing @

Gopal Choudhary, is directed to be released on

bail on furnishing bail bond of Rs. 10,000/-

(ten thousand only) with two sureties of the

like amount each to the satisfaction of

Additional Chief Judicial Magistrate,

Jhanjharpur, in connection with Madhepur P.S.

Case No. 27 of 2010, subject to condition laid

down under Section 438(2) of the Criminal

Procedure Code with additional condition to

remain physically present before the court

below on each and every till disposal of the

case, in case of failure on two consecutive

dates, the liberty shall be deemed to be

cancelled.
