Heard learned counsel for the petitioners and learned
counsel for the State.
The petitioners are an accused in a case for the
offence registered under Sections 302/34 of the Indian Penal
Code.
Learned counsel for the petitioners submits that
the prayer for bail of the petitioners was earlier rejected by a
Bench of this Court. He has further submitted that the
petitioners are in custody since long, but till date, trial has
not been concluded.
Mr. Shekhar Sinha, learned counsel for the State
has submitted that it has come in the impugned order that
the trial is at the stage of conclusion, as it is fixed for
argument.
Report was called for from the court concerned
regarding the stage of the trial. It has come, which shows
that the argument of the prosecution has already been
concluded and for the defence, it was fixed on 08.08.2011
Considering all these aspects, I am not inclined to
grant bail to the petitioner. Accordingly, the prayer for bail of
the petitioners is rejected at this stage.
However, the trial Court is directed to conclude
the trial positively within a period of one month from the
date of receipt of this order without giving unnecessary
adjournment to the defence counsel.
Office is directed to communicate this order to the
court concerned through Fax immediately.
