It is submitted by Smt.Zohra on behalf of the learned counsel for
the petitioner that the subject matter of RCR.400/2005 and the
subject matter of the present RCR is one and the same. A copy of the
judgment in RCR 400/05 is incorporated. Having gone through the
judgment, it is found that the building in question is already delivered
back to the landlord. We are of the view that nothing survives for
consideration in this RCR. Smt.Zohra would now submit that a
connected Second Appeal as 136/03 is pending before this Court. In
view of that submission, we dispose of this RCR as infructuous
observing that this judgment will not cause any prejudice to the
contentions of any of the parties in Second Appeal No.136/03.
