Heard both the parties.
Case diary of Crime No.49 of 2010 registered at
Police Station Kumhari, District Damoh for offence
punishable under Section 34(2) of M.P Excise Act is
perused.
The applicant is in custody since 5.6.2010.
Learned counsel for the applicant submits that
applicant is a reputed citizen of the locality. He has no
criminal past. At present challan has already been filed.
Case is triable by JMFC therefore, sufficient time will be
required for its disposal. Looking to the custody period
he prays for bail.
Learned Public Prosecutor informs that 54 bulk litres
of liquor was seized from the applicant.
After perusing the case diary and hearing aforesaid
arguments, without expressing any view on the merits of
the case, I am of the opinion that this is a fit case in
which bail may be granted to the applicant namely
Sampu alias Heeralal Rai.
Therefore, application of the applicant Sampu alias
Heeralal Rai under Section 439 Cr.P.C. is hereby
allowed. He be released on bail on furnishing of a bond
in sum of Rs.20,000/- (Rupees twenty thousand) with one
surety bond of the like sum to the satisfaction of trial
Court to appear before the trial Court on the dates given
by the concerned Court.
