The brief facts of the case are as under.
2. The Appellant had, in his application dated June 23, 2008, requested
the CPIO for a number of information regarding the compassionate
appointment of the wards of employees of the Department of Space (DOS).
The CPIO replied on July 23, 2008 and provided detailed information against
each of his queries. Not satisfied with the reply of the CPIO, the Appellant
approached the first Appellate Authority on August 12, 2008. That authority
decided the appeal in his order dated September 11, 2008 in which he
clarified the position in regard to one of the queries which the Appellant
had specifically raised in his appeal. The Appellant, still not satisfied, has
now come before the CIC in second appeal.
3. We heard this case through videoconferencing. The Appellant was not
present in spite of notice. The Respondent was present in the Bangalore

studio of the NIC. We heard his submissions and also examined carefully the
contents of the reply of the CPIO. The Appellant had specifically wanted to
know the basis of the calculation of posts for each of the centres of the
DOS. The first Appellate Authority had already dealt with this query in his
order. However, the Respondent also explained that the DOS strictly
followed the instructions of the DOPT in the matter of compassionate
appointment and did not devise any separate formula or scheme for
computing the numbers of posts at their level. We think that the CPIO
should explain this fact in some detail in order to remove all doubts from
the mind of the Appellant. Therefore, we direct the CPIO to write to the
Appellant within 10 working days from receipt of this order, explaining the
modality/procedure followed by the DOS in computing the number of posts
for the entire Department including the constituent units for filling up
through compassionate appointment.
4. With the above direction, the appeal is disposed off.
5. Copies of this order be given free of cost to the parties.
