Background
1. The Applicant filed an RTI application dt.30.12.08 with the CPIO, BSNL,
Bhopal seeking details of his appointment in BSNL, Indore as casual labourer
including the dates on which he had worked during the years 1987, 1988 and
1989, his tasks etc. The CPIO replied on 28.1.09 enclosing 8 pages of
information. Not satisfied with the reply, the Applicant filed an appeal
dt.3.2.09 with the Appellate Authority. The Appellate Authority replied on
21.3.09 informing the Applicant that information has been provided to him
earlier and enclosing additional information, Being aggrieved with the reply,
the Applicant filed a second appeal dt.5.8.09 before CIC stating that
information provided in para 2 of the Appellate Authority’s reply is misleading
and that some information has not been provided on the pretext that the files
are more than 21 years old.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for October 23, 2009.

4. The Applicant was not present during the hearing.
Decision
5. The Commission on reviewing the information observed that all available
information has been provided to the Appellant. The Respondent submitted
that the old files have been weeded out as per rules for preservation of
records. However, in view of the fact that the Appellant is convinced that files
more than 21 years old are available in BSNL Office, and as agreed to by the
Respondent, the Commission directs the CPIO to allow the Appellant inspect
all relevant files and to give him certified copies of documents he requires.
The CPIO is also directed to provide a certified copy of the rules for
preservation of records to the Appellant along with the proof of the relevant
files having been weeded out o the Appellant by by 15.11.09.
6. The appeal is accordingly disposed of.
