                    No.CIC/PB/C/2008/0479-SM dated 06.05.2007
Right to Information Act-2005-Under Section (19)

                                                                    Dated 01.06.2009
Complainant : Shri Kamla Kant Verma

Respondent : Central Bank of India

The Complainant is not present, in spite of notice.

On behalf of the Respondent, Shri Sanjay Srivastav, Assistant Manager, is
present.

The brief facts of the case are as under.

2. The Complainant had requested the Branch Manager on 6 May 2007 for same
information regarding the amount of money deposited in and withdrawn from a
particular account of that Branch year-wise for a particular period. The Branch
Manager wrote to him on 1 June 2007 and denied the information on the ground that
this was about the account details of a third-party which could not be disclosed. It is
against this denial that the Complainant has approached this Commission.

3. During the hearing, the Complainant was not present. We heard the
submissions of the Respondent. The Respondent explained that the Complainant had
wanted to know about the details of the account of a third party and the third-party,
when consulted, had objections to the disclosure of the information sought. He further
explained that, after the Bank heard from the CIC about the complaint, once again,
they had consulted the account holder in writing and with their permission, the
information sought had since been provided to the Complainant on 29 July 2008. We
find no fault with the Branch Manager in denying the information in the first place as,
indeed, the information was about the account details of the third-party account
holder and such information is exempt from disclosure under Section 8(1)(d) of the
Right to Information (RTI) Act, being in the nature of commercial confidence. Now
that the information sought has been provided, there is nothing more to be done in
this case.
