                                         ORDER

This is an appeal petition dated 2.6.2008 filed by Shri Mohan Shyam, New Delhi
against his first appeal dated 3.3.2007 filed before the Department of Expenditure, New
Delhi relating to his RTI request dated 13.20.2006.

2. As the 2nd appeal was filed after a lapse of more than one year, a notice was issued
to the appellant vide No. CIC/AT/Misc./23782/2008 dated 31.7.2008 to show cause in
writing by 20.8.2008 or orally by appearing in person on 22.8.2008, as to why his petition
dated 2.6.2008 be not rejected. However, no reply has been received from the appellant.

3. The matter was placed before the Commission. The Commission has observed that
there is unexplained delay in filing appeal and dismissed the appeal as time barred.
