FACTS
:-
By her letter of 27/09/2007, the Appellant had requested for the following
information:-
“i) How many total flats constructed showing the registration No.
…..from…..to…..
ii) flats allotted in areas, registration No. ….. from ….. to …..
a) under Cash Down
b) under Hire Purchase
c) There may be cases who have been allotted on Hire Purchase might
have opted and paid in lump sum i.e. Cash Down, please show the
Registration from …. To ….. Area wise.
The above information required for MIG Flats only and may kindly be provided
within 30 days from the receipt of the letter.”
2. By a subsequent letter dated 17/06/2008, the Appellant had sought information on
the following ten points:-
“1. Total Number of Registered Holders – only for MIG Flats.
2. Number of MIG Flats constructed under the Scheme.
3. Number of (MIG) Flats constructed in various areas of Delhi under the
Scheme.
4. Procedure of Allotment as per terms and conditions i.e. Cash Down and
Hire Purchase.
5. Flats (MIG) Allotted in various areas on Cash Down and Hire Purchase
year wise/per lot constructed.
6. How many (MIG) flats cancelled on account aof payment not made on
your demand as Cash Down.
7. There may be cases of H.P. Allottee applied for Cash Down and paid in
lump sum.
8. Disposal of cancelled MIG Flats – procedure and at what cost/price, Flats
disposed off.
9. How many registered holders have been allotted and further cancelled
whatsoever reasons/grounds may kindly give details etc.
10. Since the Launch of the Scheme – if any policy changed – valid copy of
policy changed till date – provide the copy/copies etc.

3. By letter dated 04/07/2008, Deputy Director (MIG)(H) had furnished the
following information to the Appellant:-

draw for allotment
9. How many registered holders have been allotted Pertains to system

10. Since the launch of the scheme-if any policy There is no major change in
changed – valid copy of policy changed till date- policy of the scheme
provide the copy/copies, etc.
4. Dissatisfied with the information provided to him, the Appellant had filed an
Appeal before the Appellate Authority. The Appellate Authority had disposed of the
Appeal vide letter dated 20/02/2008.
5. The present Appeal has been filed against the order of CPIO/AA.
6. The matter was heard on 31/12/2008. The Appellant is represented by her
husband Shri G.D. Grover. DDA is represented by the officers named above. The main
submission of the appellant is that the CPIO has not provided to him point-wise specific
information. According to him, in the letter dated 04/07/2008 of Deputy Director(H) in
most of the columns, it has been mentioned that the matter pertains to System
Department(Awas) but the System Department (Awas) has not furnished any information
to him.

7. In addition to the above, Shri Grover has also drawn my attention to letter dated
11/06/2008 of Deputy director (MIG)(H) wherein it is mentioned that the Appellant’s
letter dated 12/04/2008 was received by him on 22/04/2008 whereas as per the
endorsement on this letter, the letter appears to have been delivered to DDA on
16/04/2008.
8. On the other hand, the submission of Smt. Mehta is that a lot of information has
been furnished to the Appellant in regard to the flats purchased on hire purchase basis as
well as on cash-down basis.
9. After hearing both the parties, I am left with the impression that consolidated
point-wise reply has not been furnished to the Appellant. It is of no help to the Appellant
that the matter relates to the Systems Deptt. (Awas). In fact, the CPIO is required to
collect requisite information from the sister offices and transmit the same to the
Appellant.
DECISION
10. In view of the above, the matter is remanded to Smt. Asma Manzar,
Commissioner (Housing), with the direction to have the information compiled from the
concerned Departments of DDA and furnish point-wise information to the Appellant in
six weeks time. Further, she is also directed to look into the discrepancy regarding the
date of receipt of letter as referred to in para 8 above.
11. The matter stands disposed of at the Commission’s end.
