Facts

:

1. The appellant was heard on 22.07.2009.

2. The appellant has grievances regarding appointment of LPG
distributorship at the location identified in his RTI application. In this context, he
has asked for certain information, through separate two applications, relating to
the other applicants. Being not satisfied with the CPIO’s response, he has
submitted two separate appeals, which are examined together.

3. In the course of hearing, the details of information asked for and the
information supplied to him were discussed. The appellant alleged malpractices
in appointment of dealers in reserve quota for women from SC category. The
appellant stated that the candidates other than those who are covered under
reservation category, are taking undue advantage of the reservation policy. He
has asked for access to entire records, mainly the documents submitted by the
applicants for LPG dealership. The CPIO and Appellate Authority have replied
and refused to furnish the information u/s 8 (1) (e) & 11 of the Act. The appellant
pleaded for providing access to complete documents relating to process of
selection of LPG dealership.

Decision:

4. In view of perceived corruption in appointment of LPG dealership, it is
desirable to put in all the relevant documents in public domain so that the parties

themselves can ascertain that there is fair competition and appointment of LPG
dealership. The CPIO is, therefore, directed to allow inspection of the documents
in respect of award of dealership submitted by the candidates. Both the parties
should mutually decide the convenient date and time for inspection of the
documents within 15 working days from the date of issue of this decision. In so
far as the alleged corrupt practices in appointment of dealership is concerned,
the appellant is advised to submit the complaint to the Vigilance Officer, who
should investigate the matter and take appropriate action in the matter.

5. Both the appeals are thus disposed of.
